Those foreigners who request to enter Spain or who, being holders of a stay or residence permit or visa, intend to start, develop or direct an economic activity as an entrepreneur, may be provided with a Spain Entrepreneur Visa under the new Startup Law, which will be valid in the entire national territory and a validity of 3 years. Once this term has expired, they may request the renewal of the residence authorization for two years, being able to obtain permanent residence after five years.


Entrepreneurial activity is understood as an innovative activity and/or of particular economic importance for Spain and for which a favorable report has been issued by ENISA. The request will be addressed to the Large Enterprises and Strategic Groups Unit, which will automatically request a report on ENISA's activities and activities. It will be evaluated in 10 days by the relevant authorities.

What are eligibility requirements for the Entrepreneur Visa under Startup Law?

4 Eligibility Requirements

  • Having the purpose of establishing a startup in Spain that qualifies with the requirements of the New Law for Startups.
  • Be more than 18 years of age.
  • Not to appear offensive in the territories of the countries with which Spain has signed an agreement in this regard.
  • Have enough financial resources for themselves and for family members during their stay in Spain (€2,130 per month for the interested party and €532 for each member of the dependent family).

Which documents do I need to apply for the Entrepreneur Visa under Startup Law?

3 Document Required

  • A business plan containing the description of the project, product or service to be developed and the financing: necessary investments and possible sources of financing.
  • Obtain public or private health insurance from an insurance company licensed in Spain.
  • No criminal record in Spain and in the countries where you have stayed in the last two years for the offenses provided for by the Spanish legal system. In addition, a responsible statement of no criminal record for the past 5 years will be provided.
