Under this program, entrepreneurs (and their spouses and unmarried children under the age of 21) can apply for permanent residency (green card) in the United States if their business income is $1 million. It plans to create or retain 10 permanent jobs for US skilled workers. 

Registration process: 

1- Gather the necessary documents and transfer the investment to escrow. Submit Form I-526.

2- After your Form I-526 petition is approved:

  • Adjust your status as a conditional permanent resident in the United States by filing Form I-485, Application for Registration of Permanent Resident or Adjustment of Status, with the U.S. Citizenship and Immigration Services. 
  • To obtain an EB-5 visa from abroad to enter the United States, submit a DS-260, Immigrant Visa and Alien Registration application to the US Department of State. 

3- If your application is approved, you must go through a full medical examination and an interview. 

4- Issuance of the EB5 Investor Visa 

Note: Upon approval of the I-485 petition or entry into the United States on an EB-5 immigrant visa, EB-5 investors and their dependents are granted conditional green cards for two years.

  • You must have a valid passport
  • You must have a clean criminal record
  • All EB-5 investors must invest in a new commercial enterprise. Must find the project to invest on their own and take direct managerial role in overseeing it.
  • One must have a business plan to create or preserve 10 permanent full-time jobs for qualified U.S. workers
  • Applicant should provide medical and good character certificate with police report

Which documents do I need to apply for the EB5 Green Card - Direct investment Visa?

9 Document Required

  • A current passport or other valid travel identification
  • A police report with good character certificate and medical report
  • Evidence that you have invested or are actively in the process of investing in a “for profit” new commercial enterprise, which is a commercial enterprise
  • Evidence that you are or will be engaged in the management of the new commercial enterprise (either through day-to-day managerial control or through policy formulation).
  • Evidence that you have invested or are actively in the process of investing $1 million and it has been acquired through lawful means
  • Evidence that the new commercial enterprise will create at least 10 full-time positions for qualifying employees.
  • If the requisite employees have not already been hired, you will need to submit a comprehensive business plan showing that.
  • Evidence that the number of existing employees is being or will be maintained at no less than the pre-investment level for a period of at least 2 years.
  • Photocopies of tax records
