About

The H-3 Non-immigrant visa category allows foreign nationals coming temporarily to the United States as a :

  • Trainee to receive training in any field of endeavor, other than graduate medical education or training, that is not available in the foreign national’s home country.

Application Process:

In order to obtain H-3 classification, the U.S. employer or organization must file a Form I-129, Petition for Non-immigrant Worker.

H-3 visa cannot be initiated by the applicant. Instead, the applicant has to find the appropriate training program and apply to be admitted. The institution where the training program is being held should then initiate the H-3 visa process.

What are eligibility requirements for the H-3 Non immigrant Trainee Visa?

11 Eligibility Requirements

  • You need a formal invitation from the training institution.
  • Your employer or organization needs to demonstrate that the proposed training is not available in your native country;
  • You will not be placed in a position which is in the normal operation of the business and in which U.S. citizens and resident workers are regularly employed.
  • You will not engage in productive employment unless such employment is incidental and necessary to the training.
  • The training will benefit the you in pursuing a career outside the United States.
  • Your petitioner needs to describe the type of training and supervision to be given, and the structure of the training program.
  • Your petitioner needs to set the proportion of time that will be devoted to productive employment.
  • Your petitioner needs to show the number of hours that will be spent, respectively, in classroom instruction and in on–the–job training.
  • Your petitioner needs to describe the career abroad for which the training will prepare you.
  • You need a passport valid for at least 6 months.
  • You need to pay visa fee.

Which documents do I need to apply for the H-3 Non immigrant Trainee Visa?

  • Fill out Form DS-160 online.
  • Form I-129 and Form I-797.
  • Original and copies of valid passport.
  • Birth certificate.
  • 1 photograph meeting the Digital Image Requirements.
  • Documents which prove your intent to return to your home country such as a property deed, apartment lease, or future job contract.
